The writ of habeas corpus came under attack when the January 6 defendants were held without charges, in some cases, for years and largely denied bail. The defendant is presented in court to show that they are not being unlawfully detained or imprisoned (from old England days of the Magna Carta). In general, our society seems to have little regard for following rules or laws today in any matter.

The big gray area seems to be the definition of the rights of non-citizens. One extreme says they have no rights. The other demands the same due process as citizens. The Bongino/Patel twist on Epstein is creepy. I suspect the Trump admin is leveraging the heck out of people that could be charged. Presidential blackmail.
